What Hypeify Fleet is — and what your fleet operation remains responsible for.
This disclaimer is critical to the fleet product's risk posture. DOT/FMCSA, hours-of-service, hazmat, vehicle-safety, and driver-qualification obligations require attorney review before launch.
Software, Not a Motor Carrier
Hypeify Fleet provides software tools for fleet operations. Hypeify is not a motor carrier, common carrier, contract carrier, freight broker, freight forwarder, dispatcher, owner-operator service, vehicle inspector, safety auditor, hazmat shipper, or fuel-card issuer unless we expressly say so in writing.
Your Responsibilities
You are solely responsible for the safe and lawful operation of your vehicles and the conduct of your drivers, including: vehicle condition, periodic inspections (federal, state, and local), maintenance and repair, tire and brake condition, weight and load limits, hazardous-material packaging and placarding, cargo securement, accident response, and roadside compliance.
You are solely responsible for driver qualifications, including hiring, screening, training, CDL status, medical certification, drug-and-alcohol testing programs (where required), hours-of-service tracking, dispatch decisions, and disciplinary action.
Regulatory Compliance
Fleet operations are subject to a complex web of regulations, which may include U.S. Department of Transportation (DOT) and Federal Motor Carrier Safety Administration (FMCSA) rules; state department-of-transportation rules; International Registration Plan (IRP) and International Fuel Tax Agreement (IFTA) reporting; ELD / hours-of-service requirements; CSA scoring; hazardous-material regulations (49 CFR); EPA and state emissions rules; and city-, county-, or industry-specific rules (for example, fuel-wholesale or oil-and-gas hauling).
Hypeify Fleet may surface reminders, summaries, and dashboards based on data you upload or that flows in from telematics. The Service is not a regulatory-compliance tool, an ELD certified by FMCSA, an IFTA-filing service, or a substitute for a qualified safety-and-compliance professional. You are solely responsible for compliance with all applicable laws and regulations.
AI Output Must Be Reviewed
AI-assisted features in Hypeify Fleet — including maintenance-window suggestions, route summaries, anomaly flags on driver behavior or fuel use, and dispatch recommendations — may be inaccurate, incomplete, biased, or out of date. They may misread telematics signals, miscompute fuel economy, or surface incorrect maintenance windows.
You are responsible for reviewing every AI-generated output before scheduling maintenance, dispatching a vehicle, disciplining a driver, or otherwise relying on it.
Telematics, Fuel Cards, and Third-Party Data
If you connect telematics providers, ELD vendors, fuel-card issuers, dash-cam services, maintenance vendors, or other third parties, the data Hypeify ingests comes from those third parties and is governed by their terms. Hypeify does not validate the accuracy, timeliness, or completeness of upstream telematics, fuel-card, or maintenance data.
Hypeify is not responsible for outages, mis-postings, missing odometer readings, missing trips, fuel-card fraud, or any other issue arising out of third-party telematics, ELD, fuel-card, or maintenance services.
Hypeify Is Not Liable for Safety, Compliance, or Operational Decisions
To the maximum extent permitted by law, Hypeify is not responsible for accidents, injuries, deaths, vehicle damage, cargo damage, environmental release, hazmat incidents, DOT/FMCSA violations, IFTA underpayments, lost loads, missed deliveries, driver disputes, or any other consequence of decisions you make based on the Service.
