Outpost Product Disclaimer

What Hypeify Outpost is — and what your inspection program remains responsible for.

This disclaimer is critical to the field-inspection product's risk posture. Brand-standards, health/safety, hazmat, EEOC, photo-evidence and labor-law obligations require attorney review before launch.

Software, Not the Inspector

Hypeify Outpost provides software tools for organizing multi-location field inspections — site rosters, schedules, templates, photo-attached walkthroughs, scoring, branded PDF reports, an issues tracker, and a document vault. Hypeify is not a regulatory inspector, health-department auditor, environmental-compliance officer, brand-standards enforcer, mystery-shopper service, OSHA inspector, building inspector, fire marshal, or fiduciary unless we expressly say so in writing.

Your Responsibilities

You are solely responsible for designing your inspection rubric, including which items are pass/fail, which are critical/zero-tolerance, which contribute to score, what photos must be captured, what corrective actions are triggered on a fail, and how reports are distributed. The Service exposes these as configurable fields; the substantive content of your standards is yours.

You are solely responsible for the accuracy of inspection results, including the inspector's interpretation of items, the truthfulness of photo evidence, the timestamps of walkthroughs, and any conclusions drawn about a site, employee, franchisee, or vendor.

You are solely responsible for compliance with applicable laws and contracts when running the inspection program — including franchise / supply / brand agreements, employment and labor laws, anti-discrimination laws, occupational health and safety, food safety, alcohol-licensing, fire / building / health code, hazmat, environmental, and consumer-protection rules.

Photo Evidence and Privacy

Photos uploaded through the Service may capture individuals (employees, customers, franchisees, vendors), vehicles, license plates, signage, financial documents, and other potentially sensitive content. You are solely responsible for ensuring you have the legal authority to collect, store, and process those photos under applicable privacy, employment, biometric, and recording-consent laws (including state-specific two-party consent rules, biometric privacy statutes such as BIPA, and any union or works-council requirements).

Hypeify is not responsible for privacy claims, defamation claims, wrongful-termination claims, or other consequences arising out of photos uploaded by you or your inspectors.

AI Output Must Be Reviewed

AI-assisted features in Hypeify Outpost — including auto-fail flagging, severity classification of issues, suggested corrective actions, OCR or extraction from photos, and report-narrative summaries — may be inaccurate, incomplete, biased, or out of date. They may misclassify items, miscount findings, or surface incorrect severity tags.

You are responsible for reviewing every AI-generated output before treating an item as a fail, escalating an issue, disciplining an employee or franchisee, terminating a vendor, or otherwise relying on it.

Brand Standards and Third-Party Audits

Where your inspection program implements a brand owner's standards (for example, a Shell, ARCO, or Marathon retail brand audit, a QSR franchisor brand audit, or a hospitality brand-standards review), the brand owner's official audit results — not Outpost's — control the brand's compliance determination unless you have a separate written agreement with the brand owner accepting Outpost as authoritative.

Hypeify is not a party to your brand-license, franchise, supply, or vendor contracts and is not responsible for disputes arising out of those contracts.

Offline Mode and Data Integrity

The Service offers an offline mode that queues writes locally on the inspector's device when network access is unavailable and replays them when connectivity returns. Queued data is stored in the device's browser storage. Hypeify does not guarantee that queued data will be retained across browser-data clears, device resets, app reinstalls, operating-system upgrades, private/incognito sessions, or device loss. Inspectors should reconnect and confirm sync before treating a walkthrough as recorded.

Timestamps shown on inspections, photos, and reports reflect the device clock at the time of capture or the server clock at the time of sync, as labelled. They are not certified time-stamps and should not be relied upon as evidence of when something occurred in any legal or regulatory proceeding.

Data Retention, Export, and Deletion

Inspection records, photos, issues, and documents are retained while your subscription is active. On termination, your tenant data is retained for a wind-down window (described in the master Terms of Service) during which you may export it via the Service. After the wind-down window, Hypeify may permanently delete the data on a routine basis.

You are responsible for exporting and preserving records that you are required to retain for tax, regulatory, brand-audit, litigation-hold, employment, or insurance purposes before the wind-down window closes. Hypeify is not your records-management service.

Integrations, Connectors, and Public Reports

Where the Service generates a public report link, a shareable PDF, or pushes data to a third-party system (for example, a brand owner's audit portal, a ticketing tool, an email distribution list, a fuel-price feed, or an Toro tool), you are solely responsible for confirming that recipients are authorized to receive that data and that the disclosure is permitted under applicable contracts and laws. Once data is shared outside the Service, Hypeify cannot recall it on your behalf.

Third-party systems referenced or connected via the Service are operated by their respective providers under their own terms. Hypeify is not responsible for outages, errors, deletions, retention practices, or security incidents of those third-party systems.

Inspector Employment Relationship

Inspectors using the Service are engaged, managed, classified, scheduled, compensated, and directed solely by you (or your subcontractors). Hypeify does not employ, contract with, supervise, train, dispatch, or insure your inspectors and is not a joint employer with respect to them. Tools the Service exposes for scheduling and roster management are administrative conveniences and do not create any employment, agency, or franchise relationship between Hypeify and your inspectors.

Hypeify Is Not Liable for Inspection Outcomes

To the maximum extent permitted by law, Hypeify is not responsible for missed health/fire/safety violations, regulatory fines, brand-audit failures, lost franchise rights, vendor terminations, employee disputes, defamation claims, retaliation claims, or any other consequence of decisions you make based on the Service. Reports generated by the Service are records of what your inspector input — they are not certified inspections.
