What Hypeify Terminal is — and what your fuel-wholesale business remains responsible for.
This disclaimer is critical to the fuel-wholesale product's risk posture. Motor fuel tax, hazmat, common-carrier, and connector-specific obligations require attorney review before launch.
Software, Not the Distributor or Carrier
Hypeify Terminal provides software tools for fuel-wholesale distributors, jobbers, and similar operators. Hypeify is not a fuel distributor, jobber, terminal operator, common carrier, hazmat carrier, marketer of record, or pricing service unless we expressly say so in writing.
Your Responsibilities
You are solely responsible for the accuracy and completeness of your data in the Service, including: bills of lading (BOLs), terminal lift records, customer and vendor records, product and tax codes, rack-pricing inputs, posted prices, customer statements, daily balance reports, settlements, payments, rebates, audit-log entries, and any other operational data you upload or generate.
You are solely responsible for the actual physical operations underlying that data, including loading, transportation, storage, blending, marking, dyeing, and delivery of fuel; and for compliance with the contracts you have with terminals, carriers, jobbers, customers, and suppliers.
Motor Fuel Taxes and Regulatory Compliance
Motor fuel taxes — including federal excise tax, state and local fuel taxes, environmental and underground-storage-tank fees, sales tax, and biofuel credits — are complex, jurisdiction-specific, and change frequently. The Service may display or calculate tax-related figures based on data you provide and rates you configure, but Hypeify Terminal is not a tax advisor, IRS-authorized e-filer, or motor-fuel-tax compliance service.
You are solely responsible for the correct classification, calculation, collection, remittance, and reporting of all motor fuel taxes; for any required IRS Form 720 / 2290 / 8849 filings; for ExSTARS / EDI / state motor-fuel filings; for IFTA reporting if applicable; and for compliance with hazmat, DOT, EPA, weights-and-measures, and renewable-fuel regulations applicable to your operations.
AI Output Must Be Reviewed
AI-assisted features in Hypeify Terminal — including statement summaries, narrative explanations of daily balance changes, BOL matching, anomaly flags, and suggestions — may produce inaccurate, incomplete, or misleading results. AI Output is not a substitute for human review by a qualified operator, accountant, or tax professional.
You are responsible for reviewing every AI-generated output before sending it to a customer, posting it to your books, including it in a tax filing, or otherwise relying on it.
Terminal Connectors and Third-Party Data
If you connect terminal-data providers (for example, Shell US Fuels, Marathon, BP, or other supplier portals), pipeline schedulers, EDI providers, or pricing services, the data Hypeify ingests comes from those third parties and is governed by their terms. Hypeify does not validate the accuracy, timeliness, or completeness of upstream supplier data.
Hypeify is not responsible for outages, data errors, mis-postings, late files, supplier disputes, missed liftings, or other issues arising out of third-party connectors or supplier portals. Pricing or balances shown in the Service may differ from the supplier's official records, and the supplier's records will control unless otherwise agreed in writing between you and the supplier.
Hypeify Is Not Liable for Trading or Operational Decisions
Hypeify Terminal is informational software. It does not constitute advice on fuel buying, hedging, lifting strategy, customer credit, contract pricing, or any other commercial decision. Margins, statements, balances, and analytics displayed in the Service are tools, not recommendations.
To the maximum extent permitted by law, Hypeify is not responsible for fines, penalties, interest, missed filings, audits, late lifts, lifting losses, fuel theft, hazmat incidents, contractual disputes with suppliers/carriers/customers, lost margin, miscalculated taxes, miscalculated statements, payment processor errors, or any other consequence of decisions you make based on the Service.
